Backorder Policy
Gamma Sales Inc. will hold all outstanding backorders for a period of 60 days after which these backorders will be automatically cancelled. Backorders will be shipped prepaid Courier. (Most economically.) Booking backorders will automatically be cancelled after 90 days from agreed ship date.
Terms
Unless previous arrangements have been made, our regular terms are credit card. For customers on account, our terms are Net 30, from the date of the invoice. A 2% service charge (24% per annum) will be applied monthly on all accounts over 30 days. If in default of these terms, we reserve the right to institute legal proceedings in order to retrieve any outstanding amounts, as well as any cost Incurred to collect the outstanding balance. We reserve the right not to ship to accounts that are past due. All NSF cheques will be surcharged $25.00/cheque.
Return Policies
Warranty & Non-Warranty Parts Less than 30 Days Old:
A Return Authorization Number (RA) is required. Please call Gamma Sales Inc.'s Customer Service Department at 1-855-830-3810 or fax your request to 1-800-598-8663 to obtain your RA. All items that are deemed to be defective or "not as ordered" will not be subjected to shipping or handling fees. For any item that is not deemed defective, the sender will then be charged incoming and outgoing freight. Returns requested for any other reason will be subject to a 20% restocking fee plus freight charges back to Gamma Sales. All items must be returned in their original packaging, including hang tags, labels and bar codes. Packaging may not contain any dealer labels or pricing. No RA will be issued on any items after 30 days from date invoiced. All sales on obsolete and closeout items are final. Items returned without an RA number will be returned to the sender by freight collect. All backorders that are not cancelled and returned to us are subject to a 20% restocking fee plus any freight costs incurred. Please visit our Return Instructions for additional information.
Discontinued, Obsolete, Etc.
Please note: No RA number will be issued for any discontinued, obsolete, custom order replacement parts or clearance-final sale items. If you are unsure of the status of your product please check with the Customer Service Department to make sure that your item does not fall into these categories.
Damaged Shipments
Please makes sure to indicate damaged when signing for your shipment. Keep the shipment carton, hold the goods and notify us by calling Customer Service at 1-855-830-3810 for instructions. Any damaged goods or shortages must be reported to us within 10 days of date of invoice. Any claims after 10 days will be the responsibility of the receiver to pursue with the freight company.
Prices
All prices are in Canadian Dollars. Prices do not include shipping; handling charges (if any); federal, provincial and local taxes. Please contact your regional sales manager to inquire about the availability of volume and/or quantity discounts. Prices are not guaranteed and are subject to change without notice.
Material Safety Data Sheets (MSDS)
Some products have MSDS information available in the product detail and description page of of the item. Use the search function in the top blue menu. Enter the stock number of the product you are interested in and go to the item description to get the link for an MSDS PDF. Limited Warranty
Gamma Sales does not warranty any item sold by us. The manufacturers supply their own warranties and guaranties and most do not permit a distributor to make any adjustment, replace any part or accept for return or exchange any defective or unsatisfactory item. Please follow the guarantee instructions provided by the manufacturer. Manufacturers require warranty returns to be accompanied by written information regarding length of time use, what caused the failure and any information necessary. The consumer must also provide the retail invoice of the defective item. Any damages arising from the design or manufacturing of any item is the sole responsibility of the manufacturer. Most manufacturers have a warranty period of 90 days from the date of retail sale. Contact Customer Service for details on a particular product line or item.
Disclaimer and Limitation of Liability
All information provided by Gamma Sales Inc. and on Gamma Sales Inc.'s website is subject to change without notice. Gamma Sales Inc. shall in no event be liable to the original purchaser, its customers or to any other person or organization using or involving products purchased from Gamma Sales Inc. for loss of use, lost profits, inconvenience, property damage, personal injury or death arising out of breach of warranty, breach of contract, delay, negligence, strict tort liability or otherwise. IN NO EVENT AND UNDER NO CIRCUMSTANCES SHALL GAMMA SALES INC. BE LIABLE FOR INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL LOSSES OR DAMAGES. The entire liability of Gamma Sales Inc. for any claim of loss, damage or expense from any cause whatsoever shall in no event exceed, at Gamma Sales Inc.'s option, the repair, replacement cost or purchase price paid for the product purchased from Gamma Sales Inc. which directly gives rise to the claim. No action or proceeding against Gamma Sales Inc. may be commenced more than twelve (12) months after the product from Gamma Sales Inc. is initially shipped to the original purchaser.
Governing Law
Gamma Sales Inc.'s Terms and Conditions are governed by and construed in accordance with the laws of the province of Ontario, without regard to or application of conflicts or law rules and principles. If for any reason a court of competent jurisdiction finds any provision or portion of the Terms and Conditions to be unenforceable, that provision will be enforced to the maximum extent permissible so as to affect its intent and the remainder of the Terms and Conditions will continue in full force and effect. Privacy Policy
Gamma Sales Inc. respects the privacy of every individual who visits our website. We will not provide personal information to third parties for their commercial use. It is your responsibility to keep your company's user ID's and passwords which access your company's account information confidential. You can click on Edit My Profile in the event you would like to change your company's account password. In some cases we may collect information about your IP addresses to help identify and analyze trends and statistics. This information is only used for the business purposes of Gamma Sales Inc.
